Terms and conditions of service

By purchasing any service from AURORA MEDIA, the customer declares that he/she is of legal age and has the legal capacity to sign contracts. In addition, the customer expressly and fully accepts the agreements called "Terms and Conditions of Service" and the "Privacy Policy". Likewise, the client accepts that all the rules and guidelines contained in the aforementioned sections may be varied by AURORA MEDIA without prior notice at the time the company deems it appropriate.

For this reason it will be the customer's responsibility to regularly consult the above mentioned documents and be aware of their content. The customer's continued use of the service constitutes acceptance of the changes made to the aforementioned agreements, if the customer does not agree with the terms of service MUST immediately notify AURORA MEDIA and stop or cancel the use of the service. The customer must and may make this notification to AURORA MEDIA, via email.

AURORA MEDIA may cancel at any time and without prior notice the service contracted by the customer in the event that the customer incurs in any violation of the terms described herein.

Likewise, the customer guarantees that he/she is not violating any law or regulation with his/her use of the service and exempts AURORA MEDIA from any liability in case of any violation. The Customer agrees to release, indemnify and hold harmless AURORA MEDIA from any claim made against AURORA MEDIA by any third party company or person affected by the Customer's use of the purchased service.

OBJECT

The purpose of this contract is to regulate the conditions under which the client accesses and uses the services contracted in AURORA MEDIA, as well as to establish the conditions and form of remuneration of the client to AURORA MEDIA.

PRICES AND MEANS OF PAYMENT

 All our services are quoted in US dollars.

PRICES AND LIQUIDATION

 With respect to the prices of the services, the customer will be charged the prices established in the corresponding section, as offered on the website. Prices include value added tax as provided by applicable laws in the United Mexican States (16%).

In addition to the purchase price, customer shall be responsible for all taxes, including value added, excise, use, privilege, ad valorem, customs and any other similar taxes, levies, fees or charges, imposed or increased by virtue of any municipal, state, federal, international or any other nation's law, rule, ordinance or regulation with respect to the services sold to customer. In the event Seller shall, for any cause whatsoever, become obligated to pay such taxes, Buyer shall, upon request, immediately reimburse Seller for such amounts. Customer shall provide, upon Seller's request, any tax exemption certificate.

In addition, to the extent required by applicable laws in each country, customers agree to send us duly completed tax forms to enable us to make all required filings with the tax authorities.

PRICE CHANGE

We may change prices and/or introduce new charges in addition to the prices at our sole discretion with thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase prices, immediately and with contemporaneous notice.

PAYMENT

The price of the services shall be paid in advance by credit card or other method of payment accepted on the website.

TERMS OF PAYMENT

 To provide any service, it will be necessary to cover 100% of the amount including taxes.

PAYMENT METHODS

 Payments may be made via accepted credit or debit card.

We are not responsible for delays in our services in cases of fortuitous events or force majeure. Under no circumstances will AURORA MEDIA pay penalties for delays in the delivery of our services.

CANCELLATION OF THE SERVICE BY THE CUSTOMER

If the customer wishes to cancel any service contracted with AURORA MEDIA, he/she must send a cancellation request at least 30 days in advance. This notification will only be valid once its receipt has been confirmed by AURORA MEDIA to the client.

The customer is free to request AURORA MEDIA the cancellation of the service at any time he/she wishes, this is facilitated by sending the request to the AURORA MEDIA e-mail address.

CANCELLATION OF SERVICE BY AURORA MEDIA

AURORA MEDIA may cancel the service contracted by the customer at its own discretion and without prior notice to the customer in the following cases:

  • If the client has not complied with the payment in advance of the service for the contracted term.
  • If the customer has committed any violation of the commitments acquired in the "Terms and Conditions of Service".
  • AURORA MEDIA is not and will not be responsible for the integrity of the data in accounts that are cancelled, suspended or disconnected due to non-payment or violation of any rule established in this document.
  • The account may be suspended/cancelled in case of incurring in any fault to the staff of AURORA MEDIA, this includes, but is not limited to verbal, written, any kind of racial or gender discrimination; our staff is at your service, but they are professionals in their area and deserve the same as the customer the respect due.
  • Accounts cancelled, suspended or disconnected due to any violation of the rules established in this agreement will NOT be able to request a refund because by violating this agreement they automatically lose all the guarantee offered by AURORA MEDIA.
  • If the customer has not complied with their payments within 7 days after the due date of their billing, the data stored in their account will be completely deleted from our Data Center, without any right to claim, because the date of payment of the service is clearly established.

SECURITY

The customer will be solely responsible for any security breach affecting servers or accounts under their control. If your server is responsible for or involved in an attack or unauthorized access to another server or system, AURORA MEDIA will immediately disable the service.

INTELLECTUAL PROPERTY RIGHTS

The customer guarantees AURORA MEDIA that:

  • You are at least 18 years of age if you are an individual.
  • It has the legal right and ability to enter into this agreement.
  • You will use the contracted service only for lawful purposes and in accordance with this agreement and all applicable policies and guidelines.
  • The content of your account does not infringe or violate any third party rights (including intellectual property rights) or any applicable law, regulation or ordinance.

RESPONSIBILITIES

AURORA MEDIA shall not be liable in case of any unauthorized access, alteration or destruction of information distributed or made available using its services.

The customer must ensure the security of the user name, password and data given by the company for access to your account. The handling of these data by the user will not be the responsibility of AURORA MEDIA.

LIMITATION OF LIABILITY

In no event shall AURORA MEDIA or its suppliers be liable to you for any consequential, special, incidental or indirect damages of any kind arising out of the use or inability to use the software, even if AURORA MEDIA or its supplier has been advised of any such claim by a third party.

PRIVACY

AURORA MEDIA does not collect any personal information, such as passwords, credit or debit cards, or other personally identifiable information.

AUTHOR'S RIGHT

The Software is licensed, not sold. You acknowledge that no title to the intellectual property in the Software is transferred to you. You further acknowledge that title and full ownership of the rights in the Software shall remain the exclusive property of AURORA MEDIA and its suppliers, and you will not acquire any rights in the Software except as expressly set forth above.

REVERSE ENGINEERING

You agree that you will not attempt to reverse compile, modify, translate or disassemble the Software, in whole or in part. Any breach of the foregoing or any other terms and conditions contained herein shall result in automatic termination of this license and reversion of the rights granted hereunder to AURORA MEDIA.

CHANGES

This "Terms and Conditions of Service" agreement may change at any time and the client accepts that all the rules and guidelines contained in it may be varied by AURORA MEDIA without prior notice at the time that AURORA MEDIA deems it convenient. For this reason it will be the client's responsibility to regularly consult this section and be aware of its content on its website.
